jpnn.com, JAKARTA - The Attorney General's Office has responded to the case of a woman named Valencya, or Nengsy Lim, who was sued for one year in prison for scolding her drunk husband.

The office's legal spokesman, Leonard Eben Ezer, said that the Nengsy case had received attention from Attorney General ST Burhanuddin, who ordered the junior attorney general for general crimes (Jampidum) to conduct an examination.

"After reading the news circulating regarding the handling of the case, the attorney general gave special attention and ordered a special examination," Leonard said in a press release, Monday (15/11).

Leonard said that the Jampidum had conducted a special examination of the Nengsy case.

In this examination, the Jampidum has interviewed nine people from the West Java High Prosecutor's Office, the Karawang District Attorney's Office, and the public prosecutor.

The examination has resulted in a number of findings.

First, both the Karawang District Attorney and the West Java High Court did not have a sense of crisis or sensitivity.

Second, the public prosecutor did not understand the guideline Number 3/2019 concerning Criminal Prosecutions for General Crimes.

Third, the public prosecutor at the Karawang District Attorney had postponed the reading of criminal charges four times, with the excuse provided to the panel of judges being that the proposed lawsuit had not been approved by the West Java Prosecutor's Office.

In fact, the proposed lawsuit, submitted on October 28, was received by the West Java Prosecutor's Office on October 29.

"Approval for criminal charges was dropped by the West Java Prosecutor's Office through a phone note on November 3. But the reading of the criminal charges by the public prosecutor was on November 11," said Leonard.

The fourth finding is that the public prosecutor did not follow Guidelines Number 1/2021 concerning Access to Justice for Women and Children in Criminal Cases.

Finally, the public prosecutor did not follow the seven Daily Orders of the Attorney General, which are the norm in handling cases.

"This can be interpreted as not carrying out the leadership's orders," said Leonard. (cuy/mcr20/jpnn)
